Microsoft ihas filed a motion for a summary judgment to dismiss Apple’s trademark filing for the term App Store.

Microsoft say the concept of an app store is “generic” and that it and others have been forced to use other terms to avoid infringing Apple’s trademark.

Apple began its trademark claim in 2008, claiming ownership of the term when used to describe “retail store services featuring computer software provided via the internet and other computer and electronic communication networks”.
